Radsport also reported that Ullrich filed charges against Professor Franke and
Professor Bannenberg but one of our sources say that the journalist of Radsport must have misunderstood Mr. Diestel and that
Ullrich did not file charges against both professors.. Bannenberg filed fraud charges against Jan Ullrich, Oscar Sevilla and
Rudy Pevenage a few months ago. Ullrichs lawyer Dr. Peter Michael Diestel said: "Until now Jan Ullrich only took
the punches. He accepted everything without a word of protest. That's over. From now on we will fight. There were so
many untruths told about Jan Ullrich, unprecedented for a German athlete."
Professor Franke received his information from Guardia Civil lieutenant Enrique
Gomez. Gomez will have to appear at a court hearing in Madrid on November 29. The Guardia Civil
lieutenant is the author of the Puerto report and is accused of unauthorized circulation and falsification of the Puerto
documents.
Although almost all federations closed their cases against riders who are allegedly involved in the Fuentes affaire,
the Swiss anti-doping commission is still investigating the Ullrich case. Bernhard Welten of the anti-doping commission
of Swiss Olympic told reporters yesterday that a decision if Swiss Olympic will file charges against Ullrich, will not be
decided before early next year. Last month Welten told Swiss daily newspaper NZZ that a decision would be made before the
end of the year. According to Welten the delay is caused by an announcement of the German and Spanish authorities that
they will send requested additional documents about the case in January. Strangely enough the Spanish authorities announced
last month that they would not provide new documents before the end of the Fuentes trail, which is expected in the summer
of 2007. The Madrid court that handles the Fuentes case also ruled that the Puerto documents are not to be used to start
disciplinary actions against riders by their cycling federation. After the court ruling several cycling federations closed
cases against allegedly involved riders like Ivan Basso, Joseba Beloki, Alan Davis and others. Former Liberty Seguros manager
Manolo Saiz even became a Pro-Tour license for the 2007 season by the UCI. According to Welten the court rule applies only
for criminal cases but the case of Swiss Olympic against Ullrich would fall under civil law. Jan Ullrich's lawyers told Cyclingheroes
that the swiss federation is not in charge.
Meanwhile German rider Jörg Jaksche is allowed to race again. Jaksche, who
lives in Austria, has an Austrian professional license and president, Rudolf Massak of the Austrian cycling federation told
reporters yesterday that his federation wil not open a case against Jaksche. Massak added that his federation
might open a case if new findings would be submitted. Jörg Jaksche has a contract with Activebay, the company which
is co-owned by Maolo saiz, until the end of 2007. At the moment it is totally unclear if Saiz still has control over
parts of the Astana squad or if he will be able to start a new team with a new sponsor.
